Bernstein analysts warn that failure to pass the bill before lawmakers leave town will likely spark an immediate correction across the sector.

The Regulatory Void Looming

Congress has become crypto's main political catalyst. Without the CLARITY Act, the industry loses momentum heading into late summer and early fall. Bernstein forecasts a tactical bottom somewhere between late Q3 and early Q4, assuming the market can stomach the volatility in between. Prediction markets on Polymarket already reflect this anxiety, with odds on the bill's passage dropping sharply as the recess window narrows.

The blockage stems from traditional banking lobbies pushing back against stablecoin yields, combined with sharp partisan disagreements between Democrats and Republicans over how to regulate the space. That gridlock has frozen progress on what could have been crypto's clearest rulebook in years.

What Fills the Gap

The SEC and CFTC aren't sitting idle. Project Crypto is stepping in to fill the legislative void, offering direct regulatory frameworks for DeFi platforms and token issuers. It's not Congress, but it's movement. The agencies may be able to provide clarity that markets desperately need, even if it lacks the formal authority that actual legislation would carry.

Bernstein's base case assumes investors will find the market's floor ahead of midterm elections, when political momentum could shift again. The near-term pain is real, but the longer view suggests this regulatory stumble might reshuffle priorities rather than derail the industry entirely.
