New York State is demanding Kalshi pay $100,000 for every wager placed on its platform without a proper gambling license. Authorities argue Kalshi operates an illegal gambling business disguised as a prediction market, sidestepping state regulations designed to protect consumers.
Unlicensed Gambling and Underage Betting Allegations
The lawsuit filed last Friday claims Kalshi’s event contracts meet the legal definition of gambling because their outcomes are uncertain, rely on chance, and are beyond bettors’ control. Despite this, Kalshi never secured the necessary license from the New York State Gaming Commission. This omission means the company evaded gambling taxes and allowed bets from users aged 18 to 20, contravening New York’s minimum age of 21 for sports betting.
State Officials Demand Compliance and Restitution
Governor Kathy Hochul criticized Kalshi for disregarding state protections, emphasizing that no company is exempt from the law. Attorney General Letitia James reinforced this stance, labeling Kalshi’s platform as an illegal gambling operation regardless of how it brands itself. New York is seeking not only hefty fines but also a ban on Kalshi’s services within the state and restitution for affected customers. This action escalates tensions in the regulatory landscape surrounding emerging prediction markets.
