A single objection filed by one class member has thrown the entire Capital One 360 Savings Account settlement off schedule. The $425 million deal, approved by a federal judge in April 2026, was on track to send payments out around July 21, 2026. That timeline is now effectively frozen, and the official settlement website warns the appeal has "substantially delayed" distribution.
What the lawsuit was actually about
Capital One launched its 360 Performance Savings Account in 2019, marketing it as a higher-yield product. The problem, according to plaintiffs, was that the bank kept paying better rates to Performance Savings holders while customers in the older 360 Savings Account quietly fell behind. Plaintiffs argued Capital One never made it clear that their original account was no longer the flagship high-yield option, meaning some customers earned meaningfully less interest than they could have. Capital One denied any wrongdoing as part of agreeing to the settlement.
Who qualifies and what happens next
Eligible customers held a Capital One 360 Savings Account at any point between September 18, 2019, and June 16, 2025. Joint account holders are included in the settlement class, though cash payments go to the primary account holder only. No claim form is required. Anyone who met the criteria and did not opt out before the March 30, 2026 deadline is automatically included.
Right now there is no revised payment date. Appeals in federal court routinely run several months, and complex ones can exceed a year. That means payouts could be pushed well into 2027. The appeal could also alter the settlement's terms or structure, though no details about the specific objection have been made public yet.
