A class action lawsuit demanding 622.66 bitcoins has been filed against BitMEX, the crypto derivatives platform, alleging fraudulent practices tied to liquidations. The case was lodged in New York's federal court on July 24, 2026, the very day BitMEX announced it would cease operations after more than a decade.
Details Behind the Lawsuit and Allegations
The current lawsuit accuses BitMEX of intentionally designing their liquidation system to profit from abrupt position closures. Plaintiffs BKX Services Inc. and David Namdar claim the platform’s internal trading desk had unfair access to confidential information, enabling them to operate even during server freezes that locked out regular users. This alleged advantage allowed BitMEX to execute liquidations benefiting the platform at the expense of its traders.
BitMEX has dismissed these claims as baseless and opportunistic, stating that similar complaints have been successfully defended in the past. The timing of this legal action coinciding with the shutdown announcement is certain to be a point of contention in court proceedings.
Recurring Accusations and the Controversial Liquidation Engine
This is not the first time BitMEX faces accusations about its liquidation engine. In 2020, another class action pointed fingers at the exchange for manipulating liquidations, but that case was voluntarily dropped in mid-2025. The new complaint goes further, alleging that liquidations happened even when traders’ collateral still held value exceeding losses, and that the surplus bitcoins were funneled into BitMEX’s insurance fund rather than returned to users. BitMEX’s use options, offering up to 100 times one’s collateral, made such liquidations especially impactful. The plaintiffs argue that this setup facilitated abusive liquidations, draining significant sums from traders during volatile market conditions.
